1.4 The Buyer is a natural or legal person who purchases goods through the e-shop.
1.5 A Consumer is a natural person who, when concluding and performing the contract, does not act within the scope of their business activity.
Article II – Order and Contract Conclusion
2.1 The buyer's order is an offer to conclude a purchase contract. The purchase contract is concluded when the order is paid (the order is binding only once paid); the seller sends the order confirmation to the buyer by e-mail without undue delay.
2.2 By submitting an order, the buyer confirms that they have read these Terms and Conditions, agree with them and accept them in full.
2.3 The seller reserves the right to refuse an order if the goods are sold out, the price was obviously stated in error, or for other serious reasons; if the order has already been paid, the seller refunds the full amount paid without undue delay, at the latest within 14 days.
2.4 The buyer may cancel an order without any sanctions until it is dispatched.
Article III – Prices and Payment Terms
3.1 All prices on the e-shop are final. The seller is a VAT payer; all prices include VAT.
3.2 Shipping costs are not included in the product price and are shown separately at checkout.
3.3 Accepted payment methods:
- Visa and Mastercard payment cards (processed by the Stripe payment gateway)
- Apple Pay
- Google Pay
3.4 Payment is due in full before the goods are dispatched. If you pay in a currency other than the euro, the amount is converted by the Stripe payment gateway; you will see the exact amount in your currency, including any conversion surcharge, before you pay.
3.5 Prices of AI credits and GridGarden Studio packages (Plus, Complete) are final, including VAT under the applicable rules or local tax. For sales outside the European Union the tax is calculated and recorded by the Stripe Tax service.
Article IV – Delivery Terms
4.1 Goods are dispatched within 5-10 business days of receiving payment, unless otherwise stated.
4.2 In case of unavailability of goods or extended delivery time, the buyer will be informed immediately.
4.3 Ownership of the goods passes to the buyer upon receipt of the goods and full payment of the purchase price.
4.4 Risk of damage to the goods passes to the buyer upon receipt of the goods.
4.5 Physical goods are sold and delivered only to the European Union countries offered in the e-shop checkout. To other countries we sell them only by agreement by email at info@gridgarden.eu.
4.6 AI credits and GridGarden Studio packages (digital content) are sold worldwide except to countries and territories where sales are restricted by EU sanctions or by the terms of our payment services (currently Russia, Belarus, Iran, North Korea, Syria, Cuba and the occupied territories of Ukraine).
Article V – Right of Withdrawal
5.1 The consumer has the right to withdraw from the contract without giving a reason within 14 calendar days of receiving the goods in accordance with applicable consumer protection laws.
5.2 The consumer returns the goods complete. The consumer is liable for any diminished value of the goods only if they handled them other than as necessary to establish their nature, characteristics and functioning (for example, if they assembled them).
5.3 The withdrawal period is met if the consumer sends the notice of withdrawal before it expires. The consumer may withdraw using the form on the “Withdrawal from the contract” page, by e-mail to info@gridgarden.eu or by post to the seller's registered address; an unequivocal statement of the decision to withdraw is sufficient. The consumer sends the goods back to the seller's registered address no later than 14 days after withdrawing.
5.4 The seller will refund to the consumer all payments received under the contract, including the costs of delivery (except for any additional costs of a delivery method other than the cheapest standard delivery offered), within 14 days of receiving the notice of withdrawal, using the same means of payment the consumer used. The seller may withhold the refund until the goods have been received back or until the consumer has supplied evidence of having sent them back.
5.5 The direct cost of returning the goods is borne by the consumer. Because of their size and weight, the goods cannot normally be returned by post – they are returned by courier in parcels, usually the same number of parcels in which they were delivered. Estimated cost based on the public GLS price list (incl. VAT): Slovakia €6.00 – €6.90 per parcel; Czechia €15 – €17 per parcel; other EU countries €15 – €51 per parcel depending on the country. A 1200 × 600 mm bed with 2 – 3 layers is returned in 2 parcels (at most €12.90 within Slovakia); the largest beds we offer in up to 23 parcels (at most €139.80 within Slovakia).
5.6 The buyer does not have the right to withdraw from the contract in cases specified by applicable consumer protection laws (e.g., custom-made products). For AI credits and GridGarden Studio packages (digital content), the consumer may withdraw within 14 days of purchase only as long as no credit has been used; once even one credit is used, the right of withdrawal ends.
Article VI – Liability for Defects and Warranty
6.1 The seller is liable for defects that the sold goods have upon receipt by the buyer.
6.2 The warranty period is 24 months and starts from the date of receipt of the goods.
6.3 We recommend that the buyer inspects the goods on receipt and reports any obvious damage to the shipment to the carrier and the seller straight away. A later report does not deprive the buyer of the right to make a claim.
6.4 The buyer can make a claim by e-mail to info@gridgarden.eu, by phone, or in writing or in person at the seller's registered address, without undue delay after discovering the defect and at the latest before the warranty period expires. The seller promptly issues the buyer a confirmation that the claim has been made (by e-mail).
6.5 The seller settles the claim within 30 days of it being made. If the goods are defective, the consumer is entitled to have the defect remedied free of charge by repair or replacement; if that is not possible or does not succeed, the consumer is entitled to a proportionate price reduction or to terminate the contract as provided by law.
6.6 For AI credits and GridGarden Studio packages (digital content), the seller is responsible for the digital content conforming to the contract throughout the period it is supplied. Packages marked “forever” are provided for as long as GridGarden Studio is operated; if the artificial intelligence model is replaced, it is replaced with a model of similar quality. The seller notifies the consumer by e-mail in advance of any change that would substantially impair the consumer's access to the purchased content; in that case the consumer may terminate the contract free of charge within 30 days.
Article VII – Personal Data Protection
7.1 The seller processes the buyer's personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable data protection laws.
7.2 Detailed information about personal data processing is available in the Privacy Policy document.
Article VIII – Alternative Dispute Resolution
8.1 The consumer has the right to contact the seller with a request for remedy if they are not satisfied with how the claim was handled or believe the seller has violated their rights.
8.2 If the seller rejects the request for remedy or does not reply within 30 days of it being sent, the consumer may submit a proposal to start alternative dispute resolution to an alternative dispute resolution body under Slovak Act No. 391/2015 Coll., for example the Slovak Trade Inspection (www.soi.sk) or another authorised entity on the list kept by the Ministry of Economy of the Slovak Republic.
8.3 Supervision over the seller is carried out by the Slovak Trade Inspection (SOI), Inspectorate for the Košice Region (www.soi.sk).
8.4 The list of alternative dispute resolution bodies is kept by the Ministry of Economy of the Slovak Republic.
Article IX – How we use feedback
9.1 When you rate the proposals of the AI architect or AI photo (your choice of proposal, thumbs up or down, labels, free text), we will use your rating to improve our artificial intelligence — its rules, quality checks and model training. We always review it ourselves first.
9.2 We will use the original photos from AI photo for training only after our review and only internally — we will never publish them.
9.3 If you delete your account, we will disconnect your ratings from you (anonymise them). Anonymised texts may remain in the training data.
9.4 After reviewing your rating of an AI design, we may credit you with credits as a reward for allowing us to use the rating to improve our artificial intelligence (mainly the AI architect in Studio). Whether and how many credits we grant is at our discretion; there is no entitlement to credits. If you object to such use (Privacy Policy, Article 12), we will not grant credits for further ratings; credits you have already received remain yours.
Article X – Final Provisions
10.1 These Terms and Conditions are valid and effective from October 13, 2026.
10.2 The seller reserves the right to change the Terms and Conditions. The current version is always available on the e-shop.
10.3 The contract and matters not governed by these Terms and Conditions are governed by the law of the Slovak Republic. A buyer who is a consumer residing in another EU Member State does not lose the protection afforded by the mandatory provisions of the law of their country of residence and may also bring proceedings before the courts of their place of residence.
10.4 If any provision of these Terms and Conditions is or becomes invalid, ineffective or unenforceable, this does not affect the validity, effectiveness or enforceability of the remaining provisions.
